I work in an industry where everyone copies other people's copied ideas. Patents aren't worth a light these days; everyone just accepts that you develop an idea, get it produced and then you have 3-6 months free reign before it gets knocked off.
You can't litigate against everyone as the only people that win there are the lawyers who ultimately want to string it out to maximise 'their' profit on the item.

Ah yes, but their take is that we copied them originally i.e. paper, gunpowder etc., so they're just exacting revenge...

Stories like this always remind me of Dyson's battle with Amway who thought they could just steal his idea. He put everything on the line, his house, business, everything and he won. He started off as an Engineer but now he's a Billionaire.

BA tried to destroy the then fledgling Virgin Airlines so Branson sold his beloved Virgin Records and told the wife the house was on the market. He took them to court and won a million in damages. He's a Billionaire now by the way. Probably not very helpful unless you want to risk your house to prove you're in the right.

It goes both ways. Plenty of little guys ripping off what companies do, without having the overheads and paying things like tax and vat, handling refunds or having insurance etc.

From my experiences, it can be best to sell the design unless you have some very strong backers.
