Default Surely not....

If you have 'used' your gun to attach a scope then surely it is being 'employed' as a device otherwise than laying your scope on the floor, you may not be reading the book on the table, but surely you are 'using' the table to rest the book? Further to that lay your arm flat on the floor, get yourself a big comfy forward biased hamster, lay hamster on forearm, have a big fekin butt hook holding her steady and reach on over to turn an oversized wheel for parallax...no?

If you are using the rifle it's in use. If it's left on its own on the ground then you are not using it and it's not in use.

If the intention of the rule is not clear we have marshals who can help clear that up.
