I would shim the action/stock fit and try another scope before jumping to any conclusions. Getting the spacing right on the stock mounting post is something I do with every new bsa rifle before I even put a scope on because this being right is very important to get a consistent poi throughout the fill.
If it is still no good take it back and get it swapped for a different one.
