My interpretation FWIW. The only problem with this Brian it being an absolute offence (as I understand it) you will still 99.9% end up with a criminal record, even if it is as lowly as a caution. They must prosecute if the evidence ( a forensic test) is there. It would then be necessary to try to overturn the forensic test result on a technicality to get the case thrown out. This sounds expensive and complicated.

With AT and no test = rock
Without AT and test = hard place
